2011年酒后驾车处罚新规定 刑事行政处罚 2011年2月25日，十一届全国人大常委会第十九次会议表决通过了刑法修正案(八)，对刑法相关条款进行了修改、增加，首次将醉酒驾车这种严重危害群众利益的行为规定为犯罪，并将于5月1日正式实施。 具体规定为：“在道路上驾驶机动车追逐竞驶，情节恶劣的，或者在道路上醉酒驾驶机动车的，处拘役，并处罚金。”醉酒驾驶的界定标准为：每百毫升血中液的酒精含量高于80(含)毫克。 饮酒后驾车的处罚标准为罚款500元，记12分，暂扣驾照3个月，醉酒驾驶的处罚标准为行政拘留15天，罚款1500元，记12分，暂扣驾照6个月。另外，根据最新的刑法修订案，2010年5月1日之后，醉酒驾驶行为将涉嫌“危险驾驶罪”，会被处以拘役和罚金。 DUI or DWI are synonymous terms that represent the criminal offense of operating (or in some jurisdictions merely being in physical control of) a motor vehicle while being under the influence of alcohol or drugs or a combination of both.[6] All states in the U.S. designate a per se blood or breath alcohol level as the threshold point for an independent criminal offense.
